defiance of the order dated 20.11.2025 passed in Writ-C No. 40788 of 2025.

पारित आदेश दिनांक 31.08.2026 का सन्दर्भ ग्रहण करने का कष्ट करें, जिसके अन्तर्गत
मा० न्यायालय में Instruction नियत दिनांक 24-09-2026 से पूर्व दाखिल किये जाने हेतु
निर्देशित किया है। मा० न्यायालय में योजित रिट याचिका संख्या-40788/2025 Dr.
Huma Narjis Fathima And Another VS STATE OF UTTAR PRADESH
AND 3 OTHERS में पारित आदेश दिनांक 20.11.2025 का सारवान अंश निम्नवत् है-
"...Petitioner seeks a writ of mandamus upon respondent no. 3 for
recovery of Rs. 52,82,627.22/- and Rs. 45,21,150.05/- from respondent
no. 4 pursuant to the order dated 02.11.2022 passed by respondent no. 2.
Without entering into the merits, present writ petition is disposed of with
a direction upon respondent no. 3 to make best efforts to ensure that
necessary recovery is made strictly in accordance with law, as
expeditiously as possible, preferably before 28.02.2026, if there is no

Collector योजित की गयी, जिसमें मा० उच्च न्यायालय द्वारा आदेश दिनांक 31.08.2026
को पारित किया गया, जिसका निर्णयांश निम्नवत है:-
"Let a copy of the contempt application be served upon Sri Raj Mohan
Upadhyay, learned Additional Chief Standing Counsel during the course
of the day who shall seek instruction before the next date.
Put up this case on 24.09.2026, as fresh."
उ०प्र० राजस्व संहिता की धारा 169 से लेकर 205 तथा सपठित नियमावली के नियम 138
से लेकर 181 तक वसूली के सम्बन्ध में दिये गये प्राविधानों में वसूली की समस्त कार्यवाही के
लिये शक्तियां उपजिलाधिकारी एवं तहसीलदार में निहित हैं।
प्रश्नगत प्रकरण में उपजिलाधिकारी सदर गौतमबुद्धनगर से प्राप्त आख्या के अनुसार बाकीदार
फर्म मै० डब्ल्यूटीसी नोएडा डेवलपमेंट कंपनी प्रा०लि०, स्थलीय पता-डब्ल्यूटीसी नोएडा, प्लॉट
नं०-टीजेड-13ए एं ड 13बी, सैक्टर-टेकजोन, ग्रेटर नोएडा औद्योगिक विकास प्राधिकरण,
गौतमबुद्धनगर के विरूद्ध उ०प्र० भू-सम्पदा विनियामक प्राधिकरण के पत्रांक-UPRERA-
EXEC01/550/2025-EXEC-UPRERA 1/137005/2025 दिनांक 29.03.2025 के
अन्तर्गत जिलाधिकारी गौतमबुद्धनगर को शिकायत संख्या-NCR144/04/92706/2022 व
शिकायतकर्ता Sarfraz Hasnain Shaikh का वसूली प्रमाण पत्र धनराशि अंकन-
45,21,150 रू0+ब्याज का मांग पत्र प्रेषित किया गया, जो सी०आर०ए० क्रमांक-12 /
2025-26 एवं पत्रांक-UPRERA-EXEC01/720/2025-EXEC-UPRERA
I/141040/2025 दिनांक 08.04.2025 के अन्तर्गत जिलाधिकारी गौतमबुद्धनगर को
शिकायत संख्या-NCR144/04/92677/2022 व शिकायतकर्ता Dr. Huma Narjis
Fathima का वसूली प्रमाण पत्र धनराशि अंकन-52,82,627 रू0+ब्याज का मांग पत्र
प्रेषित किया गया, जो सी०आर०ए० क्रमांक-19 / 2025-26, पर अंकित कर तहसील सदर
को वसूली हेतु भेजा गया।
उपरोक्त 02 वसूली प्रमाण पत्र प्राप्त होने के पश्चात् तहसीलदार सदर गौतमबुद्धनगर द्वारा
बाकीदार फर्म मै० डब्ल्यूटीसी नोएडा डेवलपमेंट कम्पनी, स्थलीय पता-डब्ल्यूटीसी नोएडा,
प्लॉट नं०-टीजेड-13ए एं ड 13बी, सैक्टर-टेकजोन, ग्रेटर नोएडा औद्योगिक विकास प्राधिकरण,
गौतमबुद्धनगर के विरूद्ध उ०प्र० राजस्व संहिता 2006 के प्रदत्त अधिकारों के तहत आर०सी०
प्रपत्र-36, मांग का अधिपत्र दिनांक ../04/2025 जारी किया गया।
उपरोक्त कार्यवाही के दौरान याचिकाकर्ता का निर्गत वसूली प्रमाण पत्र मा० IN THE
