Allahabad High Court
KULDEEPversusSTATE OF U.P. AND ANOTHER
- Decided
- Bench
- SAMIT GOPAL
Holding
The appeal is allowed; the appellant is released on bail and the order of the Special Judge is set aside.
Summary
The appellant Kuldeep appealed against the order of the Special Judge (SC/ST Act) dated 23.02.2026, seeking bail and setting aside the conviction under multiple IPC and SC/ST Act provisions. The FIR alleged that the victim's son was attacked by unknown persons, with the appellant’s name appearing only in the third statement of the injured party, raising doubts about his involvement. The court noted that the appellant was not named in the FIR, the charge-sheet was filed after a delay, and no convincing evidence linked him to the offence. Considering the lack of material indicating tampering of evidence and the grant of bail to a co‑accused, the court held that bail could be granted. Accordingly, the appeal was allowed, bail was ordered with several conditions, and the impugned order of the Special Judge was set aside.
Issues considered
- Whether the appellant Kuldeep is entitled to bail despite being charged under the SC/ST (Prevention of Atrocities) Act and various IPC sections.
- Whether the appellant was properly implicated in the FIR and charge‑sheet, given his absence from the initial statements.
- Whether the order of the Special Judge dated 23.02.2026 should be set aside.
