Holding
The Court held that bail should be granted to the appellants pending trial.
Summary
The Allahabad High Court considered four related bail appeals filed under Section 14‑A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act by Rakesh Kumar, Vipin, Aman Kumar @ Tagharu and Rajendra Tiwari, who were accused of assaulting Kuldeep, who later died. The FIR was lodged three days after the alleged incident and the post‑mortem could not conclusively determine the cause of death, with the viscera report showing no poison. The prosecution alleged that the accused were named in the FIR and participated in the assault, while the defence argued that the allegations were general, the evidence was inconclusive, and there was no risk of tampering. The Court noted the delay in filing the FIR, the lack of specific role assigned to the accused, and the absence of material indicating evidence tampering. Consequently, the Court granted bail to all appellants with strict conditions and set aside the lower court’s denial of bail.
Issues considered
- The appropriateness of granting bail to the accused under Section 14‑A(2) of the SC/ST Act pending trial.
- Whether the three‑day delay in filing the FIR and the inconclusive cause of death justify bail.
- Whether the general and omnibus nature of the allegations and lack of specific role for the accused preclude continued detention.
- Whether there is a risk of evidence tampering or interference with the investigation if bail is granted.

report dated 19.08.2026.
12. Learned counsels for the appellants submitted that the appellants have
been falsely implicated in the present case. It is submitted that common &
general have been assigned to the appellants and three other persons. It is
submitted that in so far as the injuries received by the injured are concerned,
the injury no.1 was on the left side forehead which was stitched wound and
in the internal examination the meninges were found lacerated whereas all
the other injuries were having no internal damage. It is submitted that doctor
did not opine regarding the cause of death of the deceased and viscera was
preserved which also did not find anything in it. It is submitted that as per
the prosecution case the present incident occurred on 05.03.2026 but the
injured Kuldeep was taken to the CHC on 07.03.2026 for the first time. It is
submitted that the first information report has been lodged after an
inordinate delay of 03 days. It is further submitted that the investigation in
the matter has concluded and a charge-sheet dated 21.04.2026 has been
submitted and thus there are no chances of the appellants tampering with
evidence. It is submitted that there is no specific role assigned to the
appellants. The appellants Rakesh Kumar and Vipin have no criminal history
as stated in para 24, 33 of their affidavits and are in jail since
09.03.2026. The appellant Aman Kumar @ Tagharu has criminal history of
three cases as stated in paragraph 21 of the affidavit and paragraph 03 of the
supplementary affidavit dated 01.09.2026 and is in jail since
08.04.2026. The appellant Rajendra Tiwari has criminal history of two cases
as stated in paragraph 22 of the affidavit and is in jail since 09.03.2026.
13. Per contra, learned counsel for the State opposed the prayer for bail and
submitted that the appellants are named in the first information report and
have been assigned the role of assault on the deceased Kuldeep along with
three other persons. It is submitted that the deceased was found to have
received 10 injuries on his person and thus it cannot be said that the present
incident did not occur and further that there was no role to the accused
persons since the number of injuries exceed the number of accused named in
the first information report which is 07 in number. It is submitted that the
prayer for bail be dismissed.
14. After having heard learned counsels for the parties and perusing the
record, it is evident that the accused-appellants and 03 others have been
assigned general and omnibus allegations of assault on Kuldeep. The cause

of death could not be ascertained and viscera was preserved. The viscera
report does not show anything in it. The first information report has been
lodged after an unexplained delay of 03 days. The deceased was taken to the
hospital at the first instance after 02 days of the alleged incident.
15. Looking to the facts and circumstances of this case, the nature of
evidence and also the absence of any convincing material to indicate the
possibility of tampering with the evidence, this Court is of the view that the
appellants may be enlarged on bail.
16. Let the appellants- Rakesh Kumar, Vipin, Aman Kumar @ Tagharu
and Rajendra Tiwari be released on bail in the aforesaid case crime number

whatsoever. In case, the appellants misuse the liberty of bail during trial and
in order to secure their presence proclamation under section 84 B.N.S.S.,
