Allahabad High Court

RAMASHRAY YADAV AND 7 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The appeal is dismissed as the High Court is not the proper forum to re‑appreciate the evidence at this stage.

Summary

The appellants, Ramashray Yadav and others, appealed against a conviction under Sections 191(2), 115(2), 352, 351(2) of the B.N.S. and Section 3(2)(va) of the SC/ST Act arising from FIR No. 505 of 2025. They contended that the medical examination was delayed, the injuries were minor, and the FIR was fabricated, alleging a different version of events recorded in a second FIR (No. 506 of 2025). The Special Judge had upheld the charge sheet and convicted the appellants. The High Court noted that both parties had filed FIRs with conflicting versions, and that the trial court was the proper forum to resolve factual disputes. Consequently, the Court held that the appeal could not be entertained at this stage and dismissed it. The dismissal upheld the lower court’s conviction.

Issues considered

  • Whether the High Court can entertain an appeal on the merits of the evidence when there are conflicting FIRs and the trial court is the appropriate forum for factual determination.
