Allahabad High Court

SHAHKAB AND 5 OTHERSversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The High Court quashed the FIR, holding that a settlement between the parties is permissible even for the cognizable and non‑compoundable offences alleged.

Summary

Petitioner Shahkab and five family members filed a criminal miscellaneous writ petition challenging an FIR lodged on 9 May 2026 under Sections 64(1), 85, 115(2), 352 and 351(3) of the B.N.S., 2023, arising from matrimonial discord with respondent No.4, the wife of petitioner No.1. The High Court referred the matter to its Mediation and Conciliation Centre, where the parties reached a settlement on 13 August 2026, with petitioner No.1 paying Rs.15 lakh to the wife and agreeing to live separately. Both parties, through their counsel, consented to the quashing of the FIR. Citing Supreme Court precedents that allow compromise even in certain cognizable and non‑compoundable offences, the Court held that continuing the criminal proceedings would serve no useful purpose. Consequently, the Court quashed the FIR and allowed the writ petition.

Issues considered

  • What is the effect of a settlement between parties on an FIR involving cognizable and non‑compoundable offences under the B.N.S., 2023?
  • Whether the High Court can quash an FIR on the basis of a compromise and mediation outcome.
