Allahabad High Court

ARVIND SINGH @ ARVIND KUMAR SINGH AND 2 OTHERSversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court held that the writ petition was not pressed and therefore dismissed it.

Summary

Petitioners Arvind Singh and others filed a criminal miscellaneous writ petition challenging the proceedings against them. The State filed a charge-sheet in the matter, after which the petitioners' counsel, Abhay Kumar Singh, moved that the petition be dismissed as it was no longer pressed. The respondents' counsel, G.A. and Kamlesh Kumar Tiwari, opposed the dismissal. The Court considered whether a writ petition remains maintainable after a charge-sheet has been filed. Finding that the petition was not pressed and no further relief could be granted, the Court dismissed the writ petition. The dismissal was ordered with liberty to approach the appropriate remedy under law if required.
