Allahabad High Court
YOGENDRA PRASADversusSTATE OF U.P. AND 6 OTHERS
- Decided
Holding
The High Court declined to issue mandamus and directed the petitioner to approach the competent magistrate for relief.
Summary
The petitioner, Yogendra Prasad, filed a writ petition seeking mandamus directing the police to conduct a fair investigation and arrest the accused under Sections 498-A, 304-B, 315 IPC and Sections 3/4 of the Dowry Prohibition Act, after a magistrate had ordered further investigation. The police had submitted a final report favoring the accused, which the magistrate rejected and instructed a fresh inquiry, but the police failed to comply. The petitioner alleged non‑compliance and asked the High Court to intervene. The Court held that it could not issue a writ of mandamus in this circumstance and directed the petitioner to approach the competent magistrate with an appropriate application. The petition was consequently disposed of, with liberty to the petitioner to seek relief from the magistrate.
Issues considered
- Whether a High Court can issue a writ of mandamus directing police to conduct a further investigation and make arrests under the IPC and Dowry Prohibition Act.
- Whether the petitioner has a remedy before the High Court or must approach the magistrate for enforcement of the magistrate’s order.
