Allahabad High Court
X (JUVENILE)versusSTATE OF U.P. AND 5 OTHERS
- Decided
Holding
A writ petition challenging an FIR is not maintainable once a charge‑sheet has been filed.
Summary
A juvenile petitioner filed a criminal miscellaneous writ petition in the Allahabad High Court challenging the registration of an FIR. The State, represented by the learned Additional Government Advocate, submitted that a charge‑sheet had already been filed, as per a report dated 16‑04‑2026. The Court examined the report and held that once a charge‑sheet is filed, a writ petition seeking to quash the FIR is not maintainable. Consequently, the petition was dismissed and the matter was consigned to the record. The petitioner was directed to seek any other remedy available under law.
