Allahabad High Court
LAV KUMARversusSTATE OF U.P. AND 2 OTHERS
- Decided
Holding
The court held that a writ petition challenging the FIR cannot be entertained once the charge‑sheet has been filed.
Summary
The petitioner filed a criminal miscellaneous writ petition in the Allahabad High Court challenging the registration of an FIR. No petitioner appeared before the court, while the learned Additional Government Advocate represented the State. The court examined a report dated 16‑04‑2026 indicating that the charge‑sheet had already been filed by the Director General of Police. Relying on the fact that the charge‑sheet was on record, the court held that the writ petition challenging the FIR was no longer maintainable. Consequently, the petition was dismissed and the petitioner was directed to seek any other remedy available under law.
