Allahabad High Court
SWARN SINGHversusSTATE OF U.P. AND 4 OTHERS
- Decided
Holding
A writ petition challenging an FIR cannot be entertained after the charge‑sheet has been filed.
Summary
Petitioner Swarn Singh filed a criminal miscellaneous writ petition challenging the registration of the FIR against him. The petition was heard in the revised call with no petitioner present, while the learned Additional Government Advocate represented the State. The court examined a report dated 22‑04‑2026 from the Legal Cell of the Director General of Police, Uttar Pradesh, confirming that a charge‑sheet had already been filed in the case. The court held that once a charge‑sheet is filed, a writ petition seeking to quash the FIR is not maintainable. Consequently, the petition was dismissed and consigned to the record, with a direction that the petitioner may pursue any other remedy available under law.
