Allahabad High Court

VEERPALversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The petition to quash the FIR is dismissed as the FIR discloses a prima facie case of offence.

Summary

The petitioner Veerpal filed a criminal miscellaneous writ petition seeking to quash an FIR dated 02‑09‑2026 that alleged offences under Sections 115(2), 352, 351(3) and 191(2) of the Bharatiya Nagrika Suraksha Sanhita. The High Court examined the FIR and held that it disclosed a prima facie case of commission of offence, rendering the prayer to quash untenable. Relying on Supreme Court precedents (State of Telangana v. Habib Abdullah Jellani and Neeharika Infrastructure Pvt. Ltd. v. State of Maharashtra) the Court found no ground for interference. However, the Court directed that any arrest of the petitioner must strictly comply with Section 41(1)(b) and Section 41‑A of the CrPC, Sections 35(3)‑35(7) of the B.N.S., and the guidelines laid down in Arnesh Kumar v. State of Bihar and its own earlier order in Vimal Kumar et al. v. State of U.P. The writ petition was consequently disposed.

Issues considered

  • Whether the FIR dated 02‑09‑2026 can be quashed on the ground of lack of prima facie case
  • Whether the High Court can interfere with the FIR under the principles laid down by the Supreme Court
