Allahabad High Court
SHALIGRAMversusSTATE OF UTTAR PRADESH AND 2 OTHERS
- Decided
Holding
The writ petition was dismissed as the charge sheet had already been filed, rendering the challenge to the FIR untenable.
Summary
Shaligram filed a criminal miscellaneous writ petition in the Allahabad High Court challenging the registration of an FIR. The petition was filed after the police had already filed a charge sheet, as indicated by a report dated 02.05.2026 from the Legal Cell of the Director General of Police, Uttar Pradesh. The court noted that the charge sheet had been submitted and that the petition sought to contest the FIR, which is not maintainable once a charge sheet is filed. Consequently, the bench held that the writ petition could not be entertained and ordered its dismissal. The court directed that the petitioner may pursue any other remedy available under law. The petition was dismissed and consigned to the record.
