Allahabad High Court
CHIRAG RAWATversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
A writ petition that merely challenges the FIR cannot be entertained once the charge‑sheet has been filed; therefore it must be dismissed.
Summary
Chirag Rawat filed a criminal miscellaneous writ petition in the Allahabad High Court challenging the registration of the FIR against him. The court examined an office report dated 2 May 2026 which confirmed that the charge‑sheet had already been filed by the Director General of Police, Uttar Pradesh. Since the charge‑sheet was on record, the court held that the petition, which only sought to contest the FIR, could not be entertained. Accordingly, the writ petition was dismissed and consigned to the record. The court directed the petitioner that he may pursue any other remedy available under law.
