Allahabad High Court
SACHENDRA SINGH YADAV @ SONU YADAVversusSTATE OF U.P. AND 2 OTHERS
- Decided
Holding
The writ petition was dismissed because the filing of a charge sheet precludes further challenge to the FIR through a writ.
Summary
The petitioner, Sachendra Singh Yadav, filed a criminal miscellaneous writ petition (No. 5596 of 2023) challenging the registration of the FIR against him. The State, represented by the Additional Government Advocate, submitted an office report dated 02.05.2026 indicating that a charge sheet had already been filed by the Director General of Police, Uttar Pradesh. The High Court observed that once a charge sheet is filed, the FIR is no longer amenable to challenge through a writ petition. Consequently, the Court dismissed the petition and ordered it to be consigned to the record, directing the petitioner to seek any other remedy available under law. No substantive merits of the FIR were examined as the procedural bar was deemed fatal.
