Allahabad High Court

CHETAN AGARWAL AND 2 OTHERSversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The FIR dated 04.12.2025 is quashed as the parties have settled the dispute.

Summary

Petitioners Chetan Agarwal and two others filed a criminal miscellaneous writ petition seeking quash of an FIR dated 04.12.2025 under IPC sections 85 and 115(2) BNS and Dowry Prohibition Act sections 3 and 4, and a mandamus restraining their arrest. The parties had earlier settled the dispute through the Allahabad High Court Mediation and Conciliation Centre, executing a settlement deed on 17.07.2026, which the State did not contest. The Court examined the settlement agreement, the parties' statements, and the precedent set in Gian Singh v. State of Punjab (2012). Finding that the settlement removed any purpose for prosecution, the Court allowed the writ petition and quashed the FIR. The order also effectively barred any arrest of the petitioners in connection with the FIR.

Issues considered

  • Whether an FIR can be quashed on the ground of an amicable settlement between the parties.
  • Whether a mandamus can be issued to restrain arrest pending the outcome of the writ petition.
  • Whether the provisions of IPC sections 85, 115(2) BNS and Dowry Prohibition Act sections 3, 4 are amenable to quash in view of settlement.
