Allahabad High Court
IMRANversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
A writ petition challenging an FIR is dismissed when a charge-sheet has already been filed, as the matter is no longer maintainable before the court.
Summary
The petitioner Imran filed a criminal miscellaneous writ petition challenging the FIR filed against him. The State, represented by the learned Additional Government Advocate, submitted an office report indicating that a charge-sheet had already been filed by the police. The Court noted that the filing of the charge-sheet rendered the challenge to the FIR moot. Consequently, the Court dismissed the writ petition and consigned it to the record, directing the petitioner to seek any other legal remedy available. No substantive examination of the FIR's validity was undertaken as the procedural stage had progressed beyond the petitioner's challenge.
