Allahabad High Court
SOBARAN SINGH AND 5 OTHERSversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The writ petition is dismissed as the challenge to the FIR is not maintainable once a charge-sheet has been filed.
Summary
The petitioners filed a criminal miscellaneous writ petition in the Allahabad High Court challenging the registration of an FIR. The State, represented by the learned Additional Government Advocate, submitted an office report dated 4 May 2026 indicating that a charge-sheet had already been filed by the Director General of Police, Uttar Pradesh. The Court observed that since the charge-sheet was filed, the FIR issue was no longer maintainable before the court. Consequently, the Court dismissed the writ petition and directed the petitioners to seek any other remedy available under law. The petition was consigned to the record.
