Allahabad High Court
SITANSHU DUTTAversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The writ petition is dismissed as the filing of a charge-sheet precludes further challenge to the FIR through a writ.
Summary
The petitioner filed a criminal miscellaneous writ petition challenging the registration of an FIR. The State, through its Additional Government Advocate, submitted an office report indicating that a charge-sheet had already been filed against the accused. The Court noted that once a charge-sheet is filed, the FIR issue is deemed settled for the purposes of a writ petition. Consequently, the Court held that the petition could not be entertained and ordered its dismissal. The petitioners were directed to seek any other legal remedy available under law.
