Allahabad High Court
SMT. MONIKA SINGH AND 5 OTHERSversusSTATE OF U.P. AND 2 OTHERS
- Decided
Holding
The writ petition was dismissed because the filing of a charge‑sheet precludes further challenge to the FIR before this court.
Summary
The petitioners, Smt. Monika Singh and five others, filed a criminal miscellaneous writ petition in the Allahabad High Court challenging the registration of an FIR. The State, represented by the Additional Government Advocate, submitted an office report dated 4 May 2026 indicating that a charge‑sheet had already been filed in the matter. The Court noted that the filing of a charge‑sheet signifies that the investigation is complete and the FIR issue is no longer maintainable before the court. Consequently, the judges held that the writ petition could not be entertained and should be dismissed. The petition was therefore dismissed and consigned to the record, with the petitioners directed to seek any other legal remedy available to them.
