Allahabad High Court
RAVI SHANKAR @ RAVI SHANKAR TIWARIversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The writ petition is dismissed because the filing of a charge‑sheet precludes a challenge to the FIR.
Summary
The petitioner, Ravi Shankar, filed a criminal miscellaneous writ petition in the Allahabad High Court challenging the FIR lodged against him. The State, represented by the Advocate General, submitted an office report indicating that a charge‑sheet had already been filed by the Director General of Police, Uttar Pradesh. The Court noted that the filing of a charge‑sheet renders a challenge to the FIR untenable. Consequently, the Court dismissed the writ petition and consigned it to the record, directing the petitioner to seek any other legal remedy available. No further evidence or arguments were presented as the petitioner’s counsel was absent.
Issues considered
