Allahabad High Court
MRITUNJAY JAI SINGHversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
A writ petition challenging the FIR is not maintainable once a charge-sheet has been filed.
Summary
The petitioner, Mritunjay Jai Singh, filed a criminal miscellaneous writ petition challenging the registration of the FIR against him. The State, represented by the Director General of Police, submitted a charge-sheet, which was reflected in an office report dated 4 May 2026. The Court noted that the charge-sheet had already been filed, rendering the petition to quash the FIR moot. Consequently, the Court dismissed the writ petition and consigned it to the record, directing the petitioner to seek any other legal remedy available. No substantive discussion on the merits of the FIR was undertaken as the procedural stage had advanced beyond the petitioner's challenge.
