Allahabad High Court
WAZID AND 3 OTHERSversusSTATE OF U.P. AND 2 OTHERS
- Decided
Holding
A writ petition challenging an FIR is not maintainable once the charge-sheet has been filed, and therefore must be dismissed.
Summary
The petitioners filed a criminal miscellaneous writ petition challenging the registration of the FIR against them. The State, represented by the learned Additional Government Advocate, submitted an office report indicating that the police had already filed a charge-sheet. The Court noted that once a charge-sheet is filed, the FIR cannot be contested through a writ petition. Consequently, the Court held that the petition was premature and should be dismissed. The petitioners were directed to seek any other appropriate legal remedy, and the petition was consigned to the record.
