Allahabad High Court
PADAMVEER SINGH @ TEETU AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
A writ petition challenging an FIR is not maintainable once a charge-sheet has been filed.
Summary
The petitioners, Padamveer Singh and another, filed a criminal miscellaneous writ petition challenging the registration of an FIR. The State, represented by the Assistant Government Advocate, appeared before the court. The court noted that a charge-sheet had already been filed, as per a report dated 11 May 2026 from the Legal Cell of the Director General of Police, Uttar Pradesh. Since the charge-sheet was filed, the court held that the petition, which sought to contest the FIR, could not proceed. Consequently, the writ petition was dismissed and consigned to the record, with the petitioners directed to seek any other legal remedy available.
