Allahabad High Court

AARTI DEVIversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

The Court held that the petitioner should approach the Commissioner of Police, who must ensure a fair, impartial and expeditious investigation, and therefore did not issue a mandamus.

Summary

The petitioner, Aarti Devi, filed a criminal miscellaneous writ petition seeking a mandamus directing the police to complete a fair and proper investigation into an FIR dated 05-10-2025 under Sections 115(2), 352 and 351(3) of the B.N.S., 2023. The petitioner alleged that the police were not conducting an impartial investigation. The Court observed that the petitioner could move an application before the Commissioner of Police, Prayagraj, highlighting her grievance. The Court directed the Commissioner to ensure a fair, impartial and expeditious investigation if such an application is filed. Consequently, the writ petition was disposed without granting the relief of mandamus.
