Allahabad High Court

AJAY KUMAR @ TINKUversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court held that the questioned orders were based on proper deliberation and contained no legal or jurisdictional error, thus they cannot be set aside under Section 528.

Summary

The applicant, Ajay Kumar, filed an application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita seeking to set aside a charge-sheet order dated 17‑08‑2023 and a subsequent bail‑warrant order dated 20‑11‑2025 issued by the Judicial Magistrate, Garotha, Jhansi. The applicant argued that the lower court had not properly examined the facts and that the orders were based on conjecture, rendering them erroneous. The respondent contended that the orders were issued after adequate consideration and contained no legal or jurisdictional flaws. After hearing both sides, the High Court held that the lower court’s orders were based on proper deliberation, were lawful, and free of procedural or jurisdictional defects. Consequently, the application under Section 528 was dismissed, and the parties were directed to forward a copy of the order to the lower court.

Issues considered

  • Whether the charge‑sheet and bail‑warrant orders issued by the Judicial Magistrate are liable to be set aside under Section 528 of the Bharatiya Nagarik Suraksha Sanhita.
  • Whether the lower court failed to conduct a proper factual analysis, rendering the orders vitiated by conjecture.
  • Whether there exists any legal or jurisdictional error in the questioned orders.
