The Court refused to quash the orders but directed the applicant to surrender within three weeks, kept the non‑bailable warrant in abeyance, and ordered expeditious disposal of the bail application.
Summary
The applicant Deepu filed an application under Section 528 of the B.N.S.S. seeking to quash a summoning order, a non‑bailable warrant dated 20‑01‑2026, and criminal proceedings under Section 82 of the Cr.P.C. and a complaint under Section 138 of the Negotiable Instruments Act. During the hearing, the applicant’s counsel withdrew the challenge to the warrant and criminal proceedings and only requested protection to surrender before the lower court and a speedy disposal of his bail application. The Additional Government Advocate for the State of U.P. expressed no objection to granting temporary protection if the applicant surrendered. The High Court refused to quash the orders but directed the applicant to surrender within three weeks and ordered that the non‑bailable warrant be kept in abeyance pending surrender. It further directed the lower courts to dispose of the bail application expeditiously, following the Supreme Court guidelines in Satender Kumar Antil v. CBI (2021 SCC Online SC 922). The application under Section 528 was therefore disposed of.
Issues considered
- Whether the High Court should grant protection under Section 528 B.N.S.S. to quash the summoning order, non‑bailable warrant and related criminal proceedings.
- Whether the non‑bailable warrant should be kept in abeyance pending the applicant’s surrender and bail application.
