Allahabad High Court

VIJAY KUMARversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The application under Section 528 BNSS is disposed, directing the trial court to decide the applicant’s jurisdictional objection within four weeks.

Summary

Vijay Kumar filed an application under Section 528 of the BNSS seeking a stay of the order dated 02.07.2025 of the Additional Civil Judge (Junior Division)/Judicial Magistrate in a complaint under Section 138 of the Negotiable Instruments Act concerning a dishonoured cheque. The applicant contended that he was falsely implicated and that the complaint was filed in a court lacking territorial jurisdiction, having previously been dismissed and the revision rejected. The High Court noted that the applicant had raised an objection to the trial court’s jurisdiction on 28.05.2025, which remained pending, and directed the trial court to decide this objection within four weeks of receiving the certified copy of the order. No merit of the underlying cheque‑bounce allegation was addressed. Consequently, the application under Section 528 BNSS was disposed of with the said direction.

Issues considered

  • Whether the trial court that issued summons in the cheque‑bounce complaint has territorial jurisdiction to entertain the case.
  • Whether the applicant’s objection to jurisdiction should be decided before the trial court proceeds with the complaint.
