Allahabad High Court

ANURAG KASHYAP AND 2 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court held that the criminal proceedings may be quashed as the parties have settled their grievances, and therefore exercised its inherent power under Section 482 CrPC to dismiss the case.

Summary

The applicants filed an application under Section 482 of the Criminal Procedure Code seeking to quash the charge‑sheet and the entire criminal proceeding (Criminal Case No. 36984 of 2025) relating to offences under Sections 498‑A, 323, 504, 506 IPC and Sections 3/4 of the Dowry Prohibition Act, 1961. They relied on a settlement agreement dated 7 December 2025 between the parties. The Court examined the settled law that a criminal case may be quashed when the parties have resolved their dispute, citing several Supreme Court decisions. Finding the present matter a suitable case for the exercise of its inherent powers, the Court allowed the application and ordered the complete quashing of the proceedings. The order was pronounced on 13 January 2026 by Justice Tej Pratap Tiwari.
