Allahabad High Court

JEETUversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court held that the application under Section 528 BNSS cannot be decided on the merits at this stage because the existence of an offence is a factual question to be determined by the trial court after evidence is adduced.

Summary

The applicant, Jeetu, filed an application under Section 528 of the BNSS Act challenging an order dated 02‑12‑2024 passed by the Special Chief Judicial Magistrate, Agra, in a case involving alleged offences under IPC sections 420, 467, 468, 471 and IT Act section 66. The applicant's counsel argued that no offence was made out and that the prosecution was malicious, seeking permission to file a discharge (unmochan) petition. The respondent's counsel opposed the application, contending that the matter required a full evidentiary trial. The Court examined the submissions and held that at the interlocutory stage it could not determine the existence of an offence, as factual issues must be decided by the trial court after evidence is produced. Citing several Supreme Court precedents, the Court emphasized that only a preliminary view can be taken at this stage. Consequently, the Court declined to grant any specific direction and noted that the applicant remains free to pursue the remedies available under law. The application was therefore disposed of without any order altering the earlier magistrate’s decision.

Issues considered

  • Whether the allegations under IPC sections 420, 467, 468, 471 and IT Act section 66 constitute an offence against the applicant.
  • Whether the order of the Special Chief Judicial Magistrate can be set aside by an application under Section 528 of the BNSS Act.
  • Whether the applicant is entitled to permission to file a discharge (unmochan) petition at this stage.
