The court quashed the summoning order and the N.B.W. order, setting aside the proceedings against the applicant, on account of the parties' successful mediation and settlement.
Summary
The applicant filed an application under Section 528 BNSS seeking to quash criminal proceedings arising from a Section 138 Negotiable Instruments Act complaint (Case No. 3019 of 2023) pending before the Judicial Magistrate, Jalesar. The matter was referred to the Mediation and Conciliation Centre of the Allahabad High Court, where the parties reached an amicable settlement and agreed to withdraw all pending cases against each other. The respondent did not contest the successful mediation. Relying on Supreme Court precedents (Gian Singh v. State of Punjab, Shiji v. Radhika, Manoj Sharma v. State of U.P.), the court held that the settlement justified quashing the summoning order dated 20‑11‑2023 and the N.B.W. order dated 24‑02‑2025, but only insofar as it affected the applicant. The settlement report was incorporated into the order, and the application under Section 528 BNSS was disposed of.
