Allahabad High Court

ANIL PATEL @ ANIL KUMAR PATELversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The application under Section 528 BNSS is not maintainable and is dismissed.

Summary

The applicant filed an application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita seeking to quash an order dated 08‑03‑2021 passed by the Additional Chief Judicial Magistrate, Agra, in a criminal case initiated under Section 381 of the Bharatiya Dand Sanhita and Sections 65/66 of the Income‑Tax Act. The applicant’s counsel argued that no offence was made out against him and that the prosecution was a malicious attempt to harass him, seeking permission to file a discharge petition in the lower court. The respondent’s counsel opposed the application. The High Court examined the pleadings and held that the factual disputes could not be resolved at the stage of a Section 528 application and that a prima‑facie assessment, as laid down in several Supreme Court precedents, was required. Consequently, the court rejected the prayer to quash the proceedings and dismissed the application. The judgment further noted that the applicant remains free to avail himself of other legal remedies available under law.

Issues considered

  • Whether an application under Section 528 BNSS for quashing the order of the Additional Chief Judicial Magistrate is maintainable.
  • Whether the allegations against the applicant constitute a cognizable offence or amount to malicious prosecution.
  • Whether the court can decide the matter at the prima facie stage under Section 528 BNSS.
