Allahabad High Court
MUVIN KHANversusSTATE OF U.P. AND 2 OTHERS
- Decided
- Bench
- GAUTAM CHOWDHARY
Holding
The Court declined to entertain the application and directed the applicant to seek compounding of the offence before the appropriate authority, granting interim protection in the meantime.
Summary
The applicant, Muvin Khan, filed an application under Section 528 of the B.N.S.S. seeking to set aside the cognizance order dated 14‑08‑2023 and to quash the charge sheet filed on 18‑04‑2023 in a case of alleged electricity theft under Section 135 of the Electricity Act (Amendment) 2003. The applicant argued that the offence is compoundable and expressed willingness to settle the matter, requesting time to approach the appropriate authority under Section 152 of the Electricity Act. The Power Corporation and the Additional Government Advocate did not oppose compounding of the offence. The High Court held that there was no useful purpose in keeping the application pending and directed the applicant to file a compounding application within two weeks, attaching a certified copy of the order. The Court granted interim protection for two months, barring any coercive action against the applicant, and stipulated that the protection would lapse upon default.
Issues considered
- Whether an application under Section 528 B.N.S.S. to set aside cognizance and quash the charge sheet should be entertained when the offence is compoundable.
- Whether the applicant is entitled to interim protection pending compounding of the offence.
