Allahabad High Court

DHARMENDRA CHAUHAN @ DHARMENDRA AND ANOTHERversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court declined to quash the charge sheet, finding no failure of justice or abuse of process.

Summary

The applicants filed an application under Section 528 of the BNSS seeking to quash the charge sheet dated 15‑12‑2024 and the accompanying summons in Criminal Case No.1163 of 2020, which arose from FIR No.562 of 2024 alleging offences under sections 115(2), 352 and 351(2) of the BNS Act, 2023. The High Court examined the material and observed that the dispute centred on questions of fact, which cannot be decided at the interlocutory stage, and that there was no indication of a failure of justice or abuse of process that would justify quashing. Consequently, the court declined the prayer for quashing and directed that if the applicants are not on bail they may apply for bail within 45 days, and any discharge application must be decided by the trial court within six weeks. The court also ordered that no coercive measures be taken against the applicants for a period of 45 days or until the discharge application is disposed. The application was therefore dismissed.

Issues considered

  • Whether the High Court can quash the charge sheet and proceedings under Section 528 BNSS on the basis of alleged abuse of process.
  • Whether the material on record shows a failure of justice warranting the exercise of the quash power.
