Allahabad High Court
DEEPAK GUPTA AND ANOTHERversusSTATE OF U.P. AND ANOTHER
- Decided

The court held that a successful mediation and settlement between the parties warrants the quashing of the pending criminal proceedings.
Summary
The applicants Deepak Gupta and another filed an application under Section 528 of the BNSS seeking to quash the charge sheet dated 03‑04‑2026 and the cognizance order dated 16‑06‑2025 in Criminal Case No. 23077 of 2026, which arose from Crime No. 262 of 2025. The same dispute had earlier been referred to the Mediation and Conciliation Centre of the Allahabad High Court, where the parties reached an amicable settlement and agreed to withdraw all pending cases against each other, including the present criminal proceeding. The State did not contest the fact that mediation was successful. Relying on Supreme Court precedents (Gian Singh v. State of Punjab, Shiji & others v. Radhika & others, Manoj Sharma v. State of U.P.) the court held that a settlement effected through mediation can justify the quashing of criminal proceedings. Consequently, the charge sheet, cognizance order and the entire criminal case were set aside. The settlement report of the Mediation and Conciliation Centre was made part of the order and the application under Section 528 BNSS was disposed of.
