Allahabad High Court

SOMIT SHARMA AND 3 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that, even for certain cognizable and non‑compoundable offences, a verified compromise can justify quashing the criminal proceedings under Section 528 of the B.N.S.S.

Summary

The applicants filed an application under Section 528 of the B.N.S.S. seeking to quash the charge sheet and related proceedings in a criminal case involving Sections 498A, 323, 504 IPC and the Dowry Prohibition Act, on the ground that they had reached a settlement with the second opposite party. The High Court verified the compromise and, relying on Supreme Court precedents that allow compromise even in certain cognizable and non‑compoundable offences, held that continuing the prosecution would serve no useful purpose. Consequently, the charge sheet dated 26‑07‑2023, the summons and cognizance orders dated 05‑09‑2023, and the entire proceeding of Case No. 7999 of 2023 were quashed with respect to the applicants. The State counsel raised no objection to the quashing. The Court therefore allowed the application under Section 528, effectively terminating the criminal proceedings against the applicants.

Issues considered

  • Whether a compromise between parties can be the basis for quashing proceedings in cognizable, non‑compoundable offences under Sections 498A, 323, 504 IPC and the Dowry Prohibition Act.
  • Whether Section 528 of the B.N.S.S. empowers the court to quash a charge sheet and related orders on the ground of a verified compromise.
