Allahabad High Court

DWARIKA AND ANOTHERversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that under Section 482 CrPC and Section 528 BNSS it is not required to assess the material’s reliability or the defence at this stage, and therefore rejected the application to set aside the order.

Summary

The applicants Dwarika and another filed an application under Section 528 of the BNSS seeking to set aside an order dated 05‑01‑2022 passed by the Additional Civil Judge/Judicial Magistrate that stayed the criminal proceedings against them. The High Court examined the allegations, which disclosed cognizable offences under various IPC sections and the Pandemic Act, and held that under Section 482 of the CrPC and Section 528 BNSS the court need not assess the veracity of the material collected or consider the disputed defence at this stage. Consequently, the prayer to cancel the order and the proceedings was rejected. The applicants’ counsel then requested that the trial court be directed to consider their bail application, citing the Supreme Court’s guidelines in Satendra Kumar Antil v. CBI. The High Court observed that the Supreme Court directions are sufficient and no specific direction was required. The application was therefore disposed of without granting relief.

Issues considered

  • Whether the High Court can set aside the order of the Additional Civil Judge/Judicial Magistrate under Section 528 BNSS.
  • Whether the court must examine the veracity of the material collected and consider the defence at the stage of the application.
  • Whether the High Court should issue specific directions to the trial court regarding the bail application in view of the Supreme Court’s guidelines.
