Allahabad High Court

AMAN YADAV ALIAS ANAM AND 3 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The charge sheet dated 25‑07‑2024 and the cognizance order dated 21‑10‑2024 are quashed and set aside due to non‑compliance with Rule 5(3)(a) of the Gangster Rules, 2021.

Summary

The applicants filed an application under Section 528 of the Criminal Procedure Code seeking to quash the charge sheet dated 25‑07‑2024 and the cognizance order dated 21‑10‑2024 in a Special Session Trial under the U.P. Gangster and Anti‑Social Activities (Prevention) Act. The High Court examined the instructions provided by the authorities and noted that no minutes of the meeting authorising the gang‑chart were prepared, a breach of Rule 5(3)(a) of the Gangster Rules, 2021. The court held that the procedural lapse rendered the approval of the gang‑chart invalid, and consequently the charge sheet and the cognizance order were unsustainable. Accordingly, the application was allowed and the impugned orders were quashed. The court, however, clarified that the authorities may re‑initiate proceedings in the future if they comply strictly with the law.

Issues considered

  • Whether the failure to comply with Rule 5(3)(a) of the Gangster Rules, 2021 in approving the gang‑chart warrants quashing of the charge sheet and cognizance order.
  • Whether the High Court can set aside the proceedings under Section 528 CrPC on the ground of procedural irregularity.
