Allahabad High Court

SNEHANSH UPADHYAYversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court held that, given the parties’ settlement and the absence of any useful purpose in continuing the prosecution, the criminal proceedings under Section 305 BNSS may be quashed under Section 528 BNSS.

Summary

The applicant, Snehansh Upadhyay, filed an application under Section 528 of the BNSS Act seeking to quash the criminal proceedings arising from FIR No.126 of 2024 and the charge‑sheet dated 30‑08‑2024 under Section 305 BNSS, as well as a summoning order dated 17‑02‑2025. The applicant and the second opposite party had amicably settled the dispute and the latter expressed no desire to continue prosecution. Both parties, including the State’s A.G., consented to the compromise. The Court referred to several Supreme Court decisions that permit compromise even in cognizable and non‑compoundable offences. Considering the settlement and the lack of any useful purpose in continuing the case, the Court quashed the charge‑sheet and the summons and allowed the application under Section 528.

Issues considered

  • Whether a compromise between parties can be permitted to quash criminal proceedings in a case involving a cognizable, non‑compoundable offence under Section 305 BNSS.
  • Whether the court may exercise its power under Section 528 BNSS to dismiss the charge‑sheet and summoning order upon the parties’ settlement.
