Allahabad High Court

SMT HARVANSH KAURversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court allowed the anticipatory bail application, granting bail subject to bond and conditions.

Summary

The applicant, Smt Harvansh Kaur, sought anticipatory bail under Section 482 of the CrPC in a case involving alleged illicit liquor possession and assault on police officers, with charges under multiple IPC sections and other statutes. She contended that she was falsely implicated, was a minor at the time of the alleged incident, has no criminal record, and has not been served any summons or warrant, but a proclamation was issued against her. The State opposed the bail, citing the seriousness of the offences. The Court, referring to the principles laid down in Siddharam Satlingappa Mhetre v. State of Maharashtra, evaluated the nature of the accusations, the applicant’s antecedents, and the risk of flight or tampering with evidence. Finding that the applicant was willing to cooperate and posed no flight risk, the Court granted anticipatory bail with a personal bond and specific conditions. The bail may be cancelled if any condition is breached.

Issues considered

  • Whether anticipatory bail should be granted to the applicant under Section 482 CrPC in view of the nature and gravity of the offences alleged.
  • Whether the applicant poses a risk of fleeing from justice or tampering with evidence.
  • Whether the applicant’s antecedents and lack of prior criminal record justify the grant of bail.

1. Heard Shri Sanjay Singh, learned counsel for the applicant, Shri B.P.
Maurya, learned A.G.A. for the State and perused the record.

2. The present application has been moved seeking anticipatory bail in
Case Crime no.898 of 2009, under Sections 147, 148, 149, 307, 353, 332,
427, 224, 225, 186, 189 of I.P.C. and Section 7 of Criminal Law
Amendment Act and Section 60(2) of Excise Act, Police Station Bilaspur,
District Rampur, with the prayer that in the event of arrest, applicant may
be released on bail.

3. It has been argued by the learned counsel for the applicant that
applicant is innocent and she has been falsely implicated in this case. It is
further submitted that charge sheet in this case has already been submitted
and the applicant was having no knowledge of the proceedings of the case
and the applicant was aged about 17 years at the time of the alleged
incident and thereafter, she got married and she shifted to Uttrakhand. It is
further submitted that the applicant has never been served any summon or
bailable warrant or non bailable warrant and now the process of
proclamation has been issued against her and the applicant is ready and
willing to cooperate in the trial. It is also submitted that the applicant is
having no criminal history. It was also submitted that applicant

of bail and will co-operate with the investigation and would obey all

by the applicant and other co-accused persons, however, none of the
injuries of the police personnel ha been found to be grievous in nature or

and the applicant has never been served any summon or bailable warrant
or non bailable warrant and now the process of proclamation has been

nature and gravity of accusation, antecedent of accused, possibility of
accused to flee from justice and that Court must evaluate entire available
material against the accused carefully and that the exact role of the
accused has also to be taken into consideration.

7. In the instant case, considering the settled principle of law regarding
anticipatory bail, submissions of the learned counsel for the parties, role
of applicant and all attending facts and circumstances of the case, without
expressing any opinion on merits, a case for anticipatory bail is made out.
