UNIVERSITY GRANT COMMISSIONversusBOARD OF DIRECTOR EWING CHRISTIAN COLLEGE AND OTHERS

Decided

Holding

The appeal is dismissed for want of prosecution.

Summary

The University Grant Commission filed a special appeal in 2012 against the Board of Directors of Ewing Christian College. No counsel appeared on behalf of the appellant when the matter was listed for a priority hearing. The court observed that the appeal had remained pending for an extended period and that the appellant seemed disinterested in pursuing it. Consequently, the court dismissed the appeal for want of prosecution. The interim order, if any, was discharged, and the court clarified that any recall or restoration application must be supported by an affidavit of the appellant himself.

Counsel for Respondent(s) : A.S.G.I., Hem Pratap Singh,
                                                                      Shailendra, Vijay Mahendra

                                    Court No. - 1
                                                      HON'BLE AJIT KUMAR, J.
                                                      HON'BLE INDRAJEET SHUKLA, J.

                                    1. Case called out in the revised list. Nobody has put in appearance on
behalf of the appellant to press this appeal.

                                    2. The matter is of the year 2012 which is listed in the category of oldest
pending cases and for priority hearing.

                                    3. It appears, therefore, that either the appeal has rendered infructuous due
to efflux of time or the appellant is otherwise no more interested in
                                    pursuing the matter.

                                    4. In view of the above, this petition is dismissed for want of prosecution.

                                    5. Interim order, if any, stands discharged.

                                    6. It is made clear that no recall/ restoration application shall be
entertained except it is supported by an affidavit of the appellant himself.

                                                                       (Indrajeet Shukla,J.) (Ajit Kumar,J.)
