Allahabad High Court

ASHOK KUMAR SINGHversusSTATE OF UTTAR PRADESH AND 6 OTHERS

Decided

Holding

The Court declined to grant mandamus and disposed of the petition.

Summary

Ashok Kumar Singh filed a public interest litigation seeking a writ of mandamus directing the Tehsildar of Badlapur to decide a revenue case (Case No. 6174 of 2026) under Section 67 of the Uttar Pradesh Revenue Code, 2006 within three months and to ensure that all proceedings are recorded and signed on the order‑sheet. The petitioner argued that the case was initiated on 2 June 2026, registered on 27 July 2026, and thereafter only dates were fixed without any substantive hearing or the presiding officer’s signature. The State, through the Sub‑Divisional Magistrate, submitted that notices had been issued, the respondent had filed objections on 6 June 2026, and a further hearing was scheduled for 12 September 2026 after a spot inspection, after which a final order would be passed. The Court examined the submissions and found no sufficient ground to interfere with the administrative process or to compel the Tehsildar by mandamus. Consequently, the Court disposed of the petition without granting any relief.

Issues considered

  • Whether the High Court should issue a writ of mandamus directing the Tehsildar to decide the revenue case within a specified time‑frame and to ensure proper recording and signing of the order‑sheet.
