Holding
The court directed the respondent to decide the pending revision within six months, invoking Rule 183(4) of the U.P. Revenue Code Rules, 2016.
Summary
The petitioner, Om Prakash, filed a writ petition seeking a court direction to the second respondent, a revenue authority, to decide Revision No.141 of 2025 filed under Section 210 of the U.P. Revenue Code, 2006. The petitioner argued that he was the sole contesting party and that the lower court records were already on file, warranting a prompt decision under Rule 183(4) of the U.P. Revenue Code Rules, 2016. The court examined the applicability of the statutory provision that allows a time‑frame to be fixed for deciding pending revisions. It held that the court could impose such a deadline to ensure speedy disposal. Consequently, the writ petition was disposed of with an order directing the respondent to pass the appropriate order within six months of receiving the certified copy of the judgment, after hearing the parties.
Issues considered
- Whether the court can direct the revenue authority to decide a pending revision under Section 210 of the U.P. Revenue Code, 2006 within a fixed time‑frame.
- Whether Rule 183(4) of the U.P. Revenue Code Rules, 2016 empowers the court to set such a deadline.
