Allahabad High Court

DHARMVIRversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The petition is disposed, with the direction that the pending revenue proceedings be concluded after hearing the petitioner and that no coercive action be taken in the meantime.

Summary

The petitioner, Dharmvir, filed a writ petition challenging an order dated 06‑09‑2025 that constituted a revenue team to proceed under Section 67 of the U.P. Revenue Code, 2006 concerning a 0.047‑hectare land (Gata No. 988). The petitioner argued that the revenue proceedings were pending and sought relief against any coercive action. The Court examined the submissions and directed that the respondents must carry the pending revenue proceedings to their logical conclusion, providing the petitioner an opportunity of hearing and evidence. It further ordered that no coercive action be taken against the petitioner until the proceedings are disposed of, thereby maintaining the status quo. Consequently, the petition was disposed of.

Issues considered

  • Whether the order constituting a revenue team under Section 67 of the U.P. Revenue Code, 2006 can be challenged by a writ petition.
  • Whether coercive action can be taken against the petitioner while the revenue proceedings are pending.
