Allahabad High Court

SHYAMDEVversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

The Court directed the respondent to decide the pending case within three months, thereby granting the writ of mandamus.

Summary

The petitioner filed a writ petition seeking a mandamus directing the second respondent to decide a pending case (Shyamdev v. Gaon Sabha) under Section 24 of the Uttar Pradesh Revenue Code, 2006, which had been delayed since 2024 despite several dates being fixed. The petitioner argued that the delay was unreasonable and requested an expeditious decision. The court, after hearing counsel, declined to opine on the merits of the underlying case but exercised its supervisory jurisdiction to order the respondent to decide the matter within three months of the certified copy of the order, after service and hearing, and to avoid unnecessary adjournments. The direction was issued without any other legal impediment. The petition was consequently disposed of with the mandated order.

Issues considered

  • Whether the High Court can issue a writ of mandamus directing an administrative authority to decide a pending case under Section 24 of the U.P. Revenue Code, 2006.
  • Whether the delay in deciding the case constitutes an unreasonable delay warranting judicial intervention.
