Allahabad High Court

GOPESHWAR SINGHversusSTATE OF U.P. AND 7 OTHERS

Decided

Holding

The High Court directed the Naib Tehsildar to decide the pending revenue case within twelve weeks, thereby granting the writ of mandamus.

Summary

The petitioner, Gopeshwar Singh, filed a writ petition seeking a mandamus directing the Naib Tehsildar of Rudrapur to decide a pending revenue case (RST/1174/2025) concerning a land mutation. The petition alleged that despite several dates being fixed since 2025, the respondent had not rendered a decision, causing undue delay. The court examined whether it could compel the revenue officer to adjudicate the matter within a stipulated timeframe without delving into the merits of the underlying dispute. Relying on the principles of administrative efficiency and the petitioner’s right to timely justice, the court found no impediment to issuing such a direction. Consequently, the court disposed of the petition, ordering the respondent to decide the application within twelve weeks of the certified copy of the order. The order emphasized that no unnecessary adjournments be granted and that all parties be given a hearing.

Issues considered

  • Whether a writ of mandamus can be issued to compel a revenue officer to decide a pending case within a specific period
  • Whether the High Court can prescribe a time‑frame for the disposal of a revenue mutation application without addressing its merits
