Allahabad High Court

SMT. POOJA DEOLversusSTATE OF UTTAR PRADESH AND 8 OTHERS

Decided

Holding

The Court directed the respondent to consider and decide the pending case expeditiously, preferably within one year, thereby granting the relief sought in the writ petition.

Summary

The petitioner, Smt. Pooja Deol, filed a writ petition under Article 226 seeking a mandamus directing the second respondent, a revenue officer, to decide Case No. 6708 of 2023 (Arnav Singh & others v. Waheed & others) under Section 134 of the U.P. Revenue Code, 2006. The petitioner alleged that the case had been pending since 2023 despite several dates being fixed, resulting in undue delay. The Court examined whether it could issue a direction compelling the revenue officer to adjudicate the matter within a reasonable time. Without delving into the merits of the underlying dispute, the Court held that the petition could be disposed of by ordering the respondent to decide the case expeditiously. It directed the respondent to render a decision within one year of receipt of the certified copy of the order, after proper service and hearing, and to avoid unnecessary adjournments. The petition was therefore disposed of finally with the said direction.

Issues considered

  • Whether the High Court can issue a mandamus directing a revenue officer to decide a pending case under Section 134 of the U.P. Revenue Code, 2006 within a stipulated period.
