Allahabad High Court

RAM GOPALversusSTATE OF U.P. AND 12 OTHERS

Decided

Holding

The Court directed the respondent to decide the pending appeal within six months, thereby granting the writ in the nature of mandamus.

Summary

The petitioner, Ram Gopal, filed a writ petition seeking a mandamus directing the Additional Commissioner (Judicial) Prayagraj to decide appeal No. 1422 of 2024 (Laxmikant Dixit v. Rakesh Kumar) under Section 207 of the Uttar Pradesh Revenue Code, 2006, which had been pending since 2024 despite multiple dates being fixed. The petitioner argued that the delay denied justice and requested an expeditious decision. The Court, after hearing counsel, noted that the petition served no useful purpose if left pending and, without addressing the merits of the underlying appeal, ordered the respondent to decide the appeal within six months of the certified copy of the order, ensuring service and hearing, and to avoid unnecessary adjournments. The direction was issued in the nature of a mandamus. The petition was consequently disposed of.
