The Court issued a mandamus directing the Tehsildar to decide the mutation case within six months, subject to service of notice and hearing.
Summary
Petitioner Kamla Devi and others filed a writ petition seeking a mandamus directing the Tehsildar of Tilhar to dispose of a pending mutation case (Case No. 14180 of 2025) under Sections 34 and 35 of the Uttar Pradesh Revenue Code, 2006. The petition alleged undue delay despite several dates being fixed. The Court, after hearing counsel, noted that the petition served no useful purpose if left pending and, without addressing the merits of the underlying dispute, ordered the Tehsildar to decide the mutation case expeditiously, preferably within six months of the order, after serving all parties and without unnecessary adjournments. The order was signed on May 5, 2026, thereby disposing of the petition.
