Allahabad High Court

RAM ADHAR CHAUHANversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court directed the respondent to decide the pending case expeditiously within six months, thereby disposing of the writ petition.

Summary

The petitioner, Ram Adhar Chauhan, filed a writ petition seeking a mandamus directing the Additional Commissioner (Administration‑III), Gorakhpur, to decide a pending land reform case (No. 572 of 2024) under Section 331(3) of the U.P. Zamindari Abolition and Land Reforms Act, 1950. The petitioner alleged that despite several dates being fixed, the case remained undecided since 2024. The Court examined the petition and found no merit in keeping the writ petition pending. Consequently, the Court disposed of the petition and issued a direction to the respondent to decide the pending case within six months, without unnecessary adjournments, after serving all parties. The order emphasizes expeditious disposal in accordance with law.

Issues considered

  • Whether the Additional Commissioner’s failure to decide the pending case within a reasonable time warrants issuance of a mandamus.
  • Whether the High Court can direct a specific time‑frame for the disposal of the pending land‑reform case.
