Allahabad High Court

RAJ NARAYANversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The Court directed the respondent to decide the pending appeal expeditiously, preferably within six months, thereby granting the mandamus relief.

Summary

Petitioner Raj Narayan filed a writ petition seeking a mandamus directing Respondent No.2 to decide Appeal No. C202415000001985 (Vijendra Vs. Up‑Ziladhikari) pending under Section 207 of the U.P. Revenue Code, 2006. The petitioner argued that the appeal had been pending since 2024 without any decision, causing undue delay. The Court observed that keeping the writ petition pending served no useful purpose while the appeal remained undecided. Consequently, the Court disposed of the petition and issued a direction to the respondent to decide the appeal expeditiously, preferably within six months of the order. The direction also required service of notice to all parties and an opportunity of hearing, subject to the absence of any other legal impediment. The order was signed by Justice Manish Kumar Nigam on May 5, 2026.

Issues considered

  • Whether a writ of mandamus can be issued to compel a government authority to decide a pending appeal under Section 207 of the U.P. Revenue Code, 2006.
  • Whether the delay in deciding the appeal violates the statutory duty of the respondent.

                                    1. Heard learned counsel for the parties and perused the record.

                                    2. This writ petition has been filed seeking following relief :-

"Issue a writ, order or direction in the nature of mandamus commanding
the respondent no.2 to decide the Appeal No.C202415000001985
(Vijendra Vs. Up-Ziladhikari, Mehnagar, Azamgarh) under 9 207 of U.P.

                                          months."

                                    3. Learned counsel for the petitioner submitted that the above-mentioned
appeal is pending consideration since 2024 and the same has not been
decided till date. Learned counsel prayed that the same may be decided,
                                    expeditiously.

                                    4. Since the above-mentioned appeal is pending, no useful purpose would be
served in keeping this petition pending.

                                    5. In view of the above, this writ petition stands disposed of with a direction to
respondent no.2 to decide the above-mentioned appeal, in accordance with

a certified copy of this order, after ensuring service of notice upon all the
respondents and providing opportunity of hearing to all the concerned parties
provided there is no other legal impediment.
